Terms of Service
Effective date: [publication date]
These terms are an agreement between you and [registered business name], a registered business in Ontario, Canada (“we”, “us”), which runs Power Hour at joinpowerhour.com. By using Power Hour, you agree to these terms, our Privacy Policy and our Community Rules. If you don’t agree, please don’t use it.
What Power Hour is
Power Hour is a free browser party game. A host opens a private room, friends join with a code or invite link, and together you build a queue of up to 60 one-minute music-video clips that play in sync. Rooms hold 2 to 10 people. It’s based on the “power hour” drinking game, but drinking is optional and never tracked.
Who can use it
You must be at least 18 and of legal drinking age where you live. For example, that’s 19 in Ontario and 21 in the United States. This applies to hosts and guests, including in alcohol-free mode. If you’re younger, please don’t use Power Hour.
Drinking is your call
- Nobody has to drink. Alcohol-free mode works for the whole party or just for you, and sitting a round out is always fine.
- You’re responsible for your own choices, including whether and how much you drink. Never drink and drive, and look out for each other.
- Power Hour is entertainment, not advice. Confirming your age doesn’t make unsafe drinking safe.
Your account
- Hosts sign in with Google or an emailed link. Guests join with a guest profile and don’t need an email address.
- Give us accurate information, especially your age.
- Keep your email and devices secure. You’re responsible for what happens under your account.
- You can delete your account at any time from your account page. Our Privacy Policy explains what that deletes.
Hosting a party
Rooms are invite-only. Power Hour doesn’t list them, and people join with the join code or invite link, which stops working 7 days after the party is created. Share it only with people you want there, and only with people who meet the age rule. Hosts can remove any song or person from their party and lock the queue. They can also archive the party, or delete it at any time, which removes it for everyone in it. As host, you’re responsible for running your room in line with these terms and the Community Rules.
What you add
- You own what you create, like your handle, photo, notes and prompt answers.
- You give us a free, non-exclusive, worldwide permission to store, show and process it so Power Hour works. That includes showing it to the people in your rooms and on a party’s TV display. This permission ends when you delete the content or your account.
- Only upload a photo you have the right to use, and don’t post photos of other people without their OK. Anyone with the link to an uploaded photo can see it.
- You’re responsible for what you add to a queue.
- We can remove anything that breaks these terms or the Community Rules.
YouTube
Clips come from YouTube and play through YouTube’s own embedded player. Power Hour doesn’t download, store, re-encode or extract audio from YouTube videos, and it creates no file you can export. By using Power Hour, you agree to be bound by the YouTube Terms of Service.
Videos belong to their owners, and YouTube decides what’s available and where. We don’t control YouTube content and aren’t responsible for it.
Rules for using Power Hour
Don’t:
- harass, threaten or endanger anyone, or pressure anyone to drink;
- use Power Hour to score, rank or track drinking;
- get around YouTube’s restrictions or our limits;
- record, capture or redistribute anything played through YouTube’s player;
- scrape, overload or try to break into Power Hour, or run bots against it;
- use Power Hour for anything illegal.
Our part
Power Hour’s name, design and software belong to [registered business name] or our licensors. You may use Power Hour for personal, non-commercial fun. We don’t give you any other rights in it.
Price
Power Hour is free. We plan to offer paid extras, like a Host Pass. If we do, we’ll show you the price and terms before you buy, and you’ll never be charged unless you choose to buy.
Ending things
You can stop using Power Hour and delete your account at any time. We may end a party, or suspend or close an account, if someone breaks these terms or the Community Rules, or when we need to for legal or safety reasons. We may change Power Hour or stop offering it. If we shut it down, we’ll give notice in the app where we can.
Changes to these terms
We may update these terms. When we do, we’ll change the date at the top, and for significant changes we’ll tell you in the app before they take effect. If you keep using Power Hour after that, the new terms apply. If you don’t agree, stop using it and delete your account.
No guarantees
To the extent the law allows, Power Hour is provided “as is” and “as available”. We work hard to keep it running well, but we don’t promise it will always be available or free of errors, or that every video will play. YouTube can change or remove videos at any time.
If you’re a consumer, the law where you live may give you rights that these terms can’t take away. Nothing in these terms limits those rights.
Limits on our liability
To the extent the law allows:
- we’re not liable for indirect or consequential losses, lost profits or lost data;
- we’re not responsible for what anyone chooses to drink or do during or after a party, for content other users add, or for YouTube’s content or services;
- our total liability to you for any claim about Power Hour is limited to CA$100 or the amount you paid us in the 12 months before the claim, whichever is more.
Nothing in these terms limits liability that the law doesn’t allow us to limit, such as for fraud, deliberate wrongdoing or gross negligence, or for death or personal injury where the law doesn’t allow it.
Disputes
- Please contact us first at support@joinpowerhour.com. Most problems can be sorted out quickly.
- These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
- You can bring a claim in the courts of Ontario. If you’re a consumer and the law where you live lets you bring a claim in your local courts, or gives you protections we can’t contract out of, you keep them.
- There’s no arbitration clause and no class-action waiver in these terms.
The rest
- These terms, the Privacy Policy and the Community Rules are the whole agreement between you and us about Power Hour.
- If part of these terms can’t be enforced, the rest still applies.
- If we don’t enforce something right away, we can still enforce it later.
- We may transfer these terms to whoever takes over Power Hour. You can’t transfer your account to someone else.
